The firm represents clients across Florida in matters of estate planning, probate and trust administration, probate and trust litigation, trust modification and business litigation.
We know that our clients not only want to protect and transfer their assets, but also further their family and charitable values. In our estate planning practice, we assist clients with plans to transfer their wealth in a tax-efficient manner. We help people at all stages of life — from young families to high net worth business executives to retirees.
Estate planning also includes providing for medical and financial decision making during a client’s lifetime through the preparation of Durable Powers of Attorneys, Designation of Health Care Surrogates, Living Wills, and the Nomination of Preneed Guardians. We assist clients in understanding the importance of these advance directives – choosing the right surrogate decisionmakers, and ensuring that the correct documents are in place.
Probate & Trust Administration
We provide our clients with peace of mind that probate and trust administration work will be handled efficiently and properly. Following a death, we assist clients and their families through the process of settling an estate or trust. We advise trustees and fiduciaries of their obligations and make certain they are taking steps to provide appropriate notices and information to beneficiaries, as well as correctly managing, administering and distributing property held in a fiduciary capacity. We work closely with other professionals, including CPAs and financial advisors, to navigate issues and make sure our clients’ interests are protected.
Probate & Trust Litigation
We are zealous advocates for our clients’ interests. Our firm has experience in cases involving the breach of fiduciary duties by trustees, the removal of fiduciaries, will contests, contested guardianships, and disputes relating to capacity and undue influence. We represent both individual and corporate fiduciaries. We also have experience in representing taxpayers in disputes with the IRS in the United States Tax Court.
We prepare each case as if it will go to trial. We build a thorough and detailed understanding of the case facts and develop legal arguments grounded in our understanding of probate, trust and guardianship law. We have the judgment needed to help clients obtain the best possible outcome in resolving their disputes, be it through mediation or trial.
We have experience in all aspects of Florida’s guardianship laws, both in minor guardianships and in guardianships for incapacitated adults. We are sensitive to the unique challenges presented by cases where an individual has diminished mental capacity or is legally incapacitated. Additionally, we are experienced in advising clients in their rights and legal options in these challenging circumstances.
